1. Agreement to Terms

By accessing our website, requesting a quote, booking any service, or making payment to Esenai Travel Ltd (“Esenai Travel”, “we”, “our”, “us”), you agree to these Terms & Conditions.

2. Services Offered

Esenai Travel provides travel and tourism services including but not limited to:

• Flight ticketing and reservations
• Hotel bookings and accommodation
• Safari packages and tour arrangements
• Airport transfers and transport coordination
• Visa support services
• Corporate and group travel management
• Car hire and travel logistics

Esenai Travel may act as an agent between you and third-party suppliers (airlines, hotels, tour operators, transport companies, insurance providers).

3. Booking Confirmation

A booking is considered confirmed only after:

• Full payment (or required deposit) is received, and
• Confirmation is issued in writing (email, invoice confirmation, receipt, or booking reference).

Availability is not guaranteed until confirmation is issued.

4. Pricing and Currency

• Prices may be quoted in KES, USD, EUR, or other currencies depending on the service.
• Prices are subject to change due to exchange rates, airline fare updates, taxes, supplier price changes, and availability.
• Any bank charges, payment gateway fees, or mobile money charges are the responsibility of the client.

5. Payment Policy

Payments must be made within the invoice deadline. Failure to pay within the required period may result in:

• Booking cancellation
• Loss of reservation
• Fare increases

6. Client Responsibilities

The client is responsible for ensuring:

• Correct passenger names matching passport/ID
• Valid travel documents (passport validity of at least 6 months)
• Visa approvals and immigration requirements
• Vaccination and health requirements
• Compliance with airline rules and destination regulations
• Arrival on time for flights and transfers

Esenai Travel is not liable for losses resulting from incorrect or incomplete client information.

7. Changes and Amendments

Any changes requested after confirmation may result in:

• Rebooking fees
• Supplier penalties
• Fare differences
• Additional administrative charges

Changes are valid only after written confirmation from Esenai Travel.

8. Travel Documents and Visa Assistance

Esenai Travel may assist with visa applications and travel documentation. However:

• Visa approval is solely determined by embassies/immigration authorities.
• We do not guarantee visa issuance.
• Visa fees and embassy charges are non-refundable unless otherwise stated.

9. Supplier Responsibility

Airlines, hotels, tour operators, and other suppliers operate under their own terms and conditions. Esenai Travel is not liable for supplier service failure, including:

• Flight delays or cancellations
• Hotel overbooking
• Tour interruptions
• Lost baggage or property
• Accidents or injuries during travel

10. Force Majeure

Esenai Travel shall not be responsible for disruptions caused by circumstances beyond our control, including:

• Natural disasters
• War, terrorism, political unrest
• Pandemics or public health emergencies
• Strikes or transport shutdowns
• Weather-related disruptions
• Government restrictions

11. Limitation of Liability

Our liability is limited to the value of the service fees paid directly to Esenai Travel (excluding third-party supplier payments), except where prohibited by law.

12. Intellectual Property

All website content including branding, images, logos, and text belongs to Esenai Travel Ltd and may not be copied or reused without written permission.

13. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Disputes shall be resolved through Kenyan courts.
